Terms of Service

These Terms of Service ("Terms") govern your use of the What to Eat mobile application and related services (collectively, the "Service") provided by Mochi Studio ("we", "us", "our"). By downloading, installing, or using What to Eat, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

Eligibility

You must be at least 13 years old to use What to Eat. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

Permitted use

  • Use the app to discover restaurants and manage your food preferences.
  • Share restaurant recommendations with friends and family.
  • Access the Service from supported devices and operating systems.

2. User Responsibilities

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app.
  • Modify, adapt, translate, or create derivative works based on the Service without our written consent.
  • Use automated scripts, bots, or crawlers to access or interact with the Service.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Upload or transmit any malicious code, viruses, or harmful data to the Service.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mochi Studio and its licensors. Our trademarks, service marks, logos, and trade names ("Marks") may not be used in connection with any product or service without our prior written consent.

Restaurant information displayed in the app may be sourced from third-party providers (including Google Maps). Such content remains the property of the respective owners.

4. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure at all times.
  • Restaurant information displayed is always accurate, current, or complete.
  • The results obtained from using the Service will meet your expectations.
  • Any errors in the Service will be corrected.

Restaurant recommendations are generated for entertainment and convenience purposes. Always verify restaurant hours, availability, and other details before visiting.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOCHI STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

6. Third-Party Links and Services

The Service may contain links to third-party websites or services (such as App Store, Google Play, delivery platforms, or map providers) that are not owned or controlled by Mochi Studio. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you use.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through the app. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Taiwan.
